K Visa Marriage of foreign minor

Hello I am wondering if someone can from a foreign country and they over stayed the time that was given to come to the United States and they are 16yrs of age can they marry someone who is 18 with parental consent? If the legal age of consent is 16 in Georgia and the 16 yr old female and 18 yr old male have a baby can they get married with out consent? or will the boy be charged with something even though the consensual age is 16.

If you live in Rome do as the Romans do. Anyone living on US soil is subject to the same rules and privileges of US law provided they are in good standing with DHS. So, US law will apply to even foreigners here….there is no difference. If your state allows for minors of a certain age to marry, that is fine by immigration. If you entered here legally and have an I-94 and certain visa types, in many cases you are eligible to adjustment of status after marriage.
