This question regards the state of Kansas in Pottawatomie County.

This last weekend, at Country Stampede, a group of us were walking though the grass parking lot on our way into the concert. Carrying coolers, chairs, etc. Two undercover cops stopped us all and asked for I.D's. My girlfriend, age 19, happened to be carrying a Smirnoff Ice. She of course was written an M.I.P. She also present the policeman with a fake I.D which he also confiscated. The ticket reads, 1 count of Minor in Possession of Alcohol and 1 count of Fictitious Identification. I have heard several similar stories and read numerous online posts about the punishments but would like to know what charges or penalties apply for this case. Is diversion still an option? Should she get a lawyer? Possible overall cost?

Thanks for your help!

The possession charge alone isn't so bad, but presenting the fake ID may have complicated things a bit. It is still a minor offense, but she may not find the easiest way out. She is also an adult and wont necessarily get the slap on the hand a juvenile would.
Use the public defender if possible to keep costs minimal.
