Lifetime Estate Hassles

My husband grandparents left him property but its in a Lifetime estate. It was stipulated in the will that whom ever held title to the homestead would be in the remainderman of the Lifetime Estate. Since their death the homestead has changed hand four times and everytime the Life estate has transferred to the current owner until now. The current owner bought the property as the previous owner lost it to foreclosure( which my understanding is that the Life estate cannot be part of a mortgage or collateral) The thing is that the life estate did not transfer to them it is still with the previous owner. Is that legal? Shouldn't the title agent have caught this?
 
I suggest you advise your spouse to speak with an attorney, if he believes his USE of the property is threatened.
