Lawsuit by Visa

I have a few questions regarding a legal situation and was not sure who to ask.

1. Will Visa sue us for a past due credit card balance? It's at least 5 years old, might even be 6 or 7, and is only $2,000.

2. Should we give the lawyer, who is contacting us, any personal information?

3. If we don't have the money to pay, how far can they take it?

4. What should we do?

5. How does Statue of Limitations work?

We have received two calls from a lawyer who is representing Visa, and trying to collect a really old balance from my husband, Jeremy. Jeremy gave him our address but told him it was irrelevant when he asked where he works. The lawyer gave him two payment options, one in full and one with high monthly payments, which will almost double it with interest. Jeremy was supposed to call him back Friday with a decision, but I told him we need to find out our rights.

Check with your states SOL . More than likely the SOL has ran out . If it has been 7 years then they are not even aloud to keep reporting it in your credit reports . Look up the last time you made a payment . That is the date that the SOL clock starts ticking . I would not speak with that attorney unless it is still within the SOL .
