Apologies in advance if similar situations have been addressed.
We hired a landscape construction firm to complete drainage work at our home in September, 2019. Project was completed, no issues, contractor paid in full. On a follow up visit, we stated our desire to renovate the front yard area and contractor offers to build an estimate and draw up some plans. The estimate was beyond our budget and included elaborate CAD designs we neither asked for, nor approved prior to their creation.
We never moved forward with this, but days ago received an invoice for $1,275.00 in design fees. Again, never approved prior to them doing the work. I've returned the plans as we have no desire to use them in the future.
My question centers on the lack of written permission to produce the work we're being billed for. Is this a Statute of Fraud issue or am I on the hook?
