Is user behavior tracking on my website against law?

Hi,

This is my first post here.
We want to render content and internal promotion banners on our website based on user behavior and actions on various sections on my website.
For example, if a user visits a page and do not perform a action we would like him to, then on the subsequent pages and visits we would like to show him promotions accordingly.
This will mean we would probably will have to place a browser cookie on his machine for identification.
We can also term it as behavior targeting but limited to our own website.

I would like to know, is this an illegal practice? If yes, then how can we ethically do this?

Many websites do this "artfully" in a way that states that the site may use cookies to provide the user with what the site believes is a better experience, including ads that will be more relevant to the user.
