Is this legal?

My jurisdiction is: Indiana

We had recent storm damage and have received a claim check made out to me and the mortgage company. The mortgage co. had no problem signing the check and giving it back to us until they discovered I wasn't on the loan with my husband and at the time of the claim my husband wasn't listed on the insurance policy. We are both on the deed. Now they say they won't endorse it unless we refinance with me on the loan. I tried to get the insurance company to add my husband's name to the check, but they won't. So, now I have a worthless claim check. Since I pay the homeowner's insurance premium and I'm listed on the deed, is it legal for the mortgage company to refuse to sign the check? Or for the insurance comapny to refuse to issue a new check to just me or to add my husband? :(
