is this considered hacking or tresspas? criminal?

Someone accessed my personal email account and replied to two of my correspondences from an online dating site. This person pretended to be me and, though they did not tell any lies about myself, the embarrassment from having to deal w/the situation and the little white lies I myself told- well, you can imagine. Anyway, my ex husband told me he gave my email password to his girlfriend, and I highly suspect it was she who did this. It happened over a year ago, but it still rankles me. Is there any legal recourse I can take? Can I prove it was her? Regardless of who it was, is this illegal and/or punishable? It was through Yahoo and as I understand it is not easy to recover or trace emails through them and similar accounts. Is there a statute of limitations in such a case?
