Fraud, Embezzlement, Bad Checks insurance fraud

A selfemployed man is injured during the performance of his work. He claims nearly total disability (back problems) and reaches a settlement with his insurance company, (they pay him a monthly check) and also is able to get early benifits through social security. He gets the necessary paperwork from a doctor. However, unbeknowst to either his insurance company, his doctor, or the government, he continues to work his regular job, a job that requires considerable physical movement, and draws income from it. Is this insurance fraud? If so, what are the legal as well as civil reprecussions? If so, how would the government (social security dept) deal with it?
 
It is insurance fraud. The awards and costs will likely be recoverable. Insurance fraud is not an area that the social security area of government and may be dealt with by the state attorney general. Most charges for insurance fraud are felonies and punishable with imprisionment.
