Insurance claims ike recoverable depreciation

Hurricane Ike 9/13/2008:

We filed an Ike claim within the 2 year window, as allowed, on April 27, 2010. The adjuster came out and looked at the roof and agreed that it did need to be replaced. On 4/28/2010 we signed a contract with the roofer and had the roof replaced. Now, our insurance carrier is saying that we are not going to receive the Recoverable Depreciation-RCV (the $ which you're supposed to get back when the work is completed) because we didn't file a extension request to them by March 11, 2010 (which signifies 1 1/2 yrs after Ike). Well, how could we file an RCV extension request when we didn't even have a claim yet? Is this legal? It seems they are getting out of paying people's depreciation who file within the last 6 months of the allowable time. I do not think they can do this and when I called the 800-number, no one there could explain to me why the clock did not start ticking when we filed the claim. What can we do?
