My DRC made issue with our solar panel claiming not in the approved plan of 2 years ago. Never problem was until 2 years later when I asked final inspection of our landscape with return of refundable deposit.
While they made trouble with solar panel which could not have been refused per California Civil Code but possibly omitted 2 years ago by our pool contractor who had duty for all permits, and demanded to remove certain palms from our yard, yet our club house whose owner is a member of DRC has the same palms in front of club house
Can I charge DRC for inconsistent and flexible application of the rules, Business Judgment Rule? DRC member himself didn't follow rule while arranging a hearing with intention of fine.
