It would depend………..there are alternatives to jails…..other types of holding facilities…if they believe your poor health played a role. Each case is different and there are many parameters the judge will use to make such a decision. There is no one size fits all. So it would depend on a lot of factors……medical evaluation, condition, current health, attention needed….etc. But if you are not competent to stand trial, you can't be tried. They might move you to a suitable facility for a while….until they feel you are a better person……from whatever they think about you now. Then the case could be review upon completion….then dismissed.
