Can I use it if my friend was charged for a crime and I was with him but not charged? Or use it when out of court, i.e. a cop stops me when I am jogging early morning or late night.

You have the RIGHT to remain silent. You have no obligation to admit to a crime.

If you are called to court to testify, and they failed to charge you, you may be forced to testify. (They can hold you in contempt). IF it is going to incriminate you while testifying, you sure could invoke that right. as for police, it won't do you much good. YOu have to stick with your right to remain silent. You must identify yourself if asked, but that's it.
