I need our password - is this a crime?

Hi,
Our company has replaced our old phone man with a new one. The old one would only lie and say he was coming in, but never would. He used to come in only a few days late, but that dropped off to never. So we hired a new guy, but the old phone man has the password to the phone system and our new phone man needs it. Otherwise we have to take the phone system off the wall, and ship it to the manufacture so they can reset it. Is there any legal action we can take toward the old phone man? I have asked him for the password and he will not give it to me, nor will he come in to reset it.

It is probably not a crime, but it can be some tort. One should advise him that he might become liable for damages under a property interference or a business tort theory. It could become costly.
