The fiancée visa application I-129F asks:
"12. If your fiancé(e) is currently in the U.S., complete the following: Yes No
He or she last arrived as a (visitor, student, exchange alien, crewman, stowaway, temporary worker, without inspection, etc.)
Arrival/Departure Record (I-94) Number
Date of Arrival (mm/dd/yy)
Date authorized stay expired, or will expire as shown on I-94 or I-95"
My fiancée already has a tourist visa. All blogs I have read recommend marrying on the tourist visa and trying to change the status later. However, this seems risky. Marrying on a fiancée visa appears to be the correct way.
What would happen if I applied for the fiancée visa while my fiancée is here in the U.S. on the tourist visa.???
My guess is the immigration department would allow her to remains in the U.S. on her tourist visa while they process the fiancé visa.
