my husband moved out of our apartment and refuses to pay his half of the rent. both our names are on the lease. Do i have to pay full rent?
OP's recourse is to pay herself, then sue the husband.
If you don't want to risk being evicted, paying the rent is your best bet.
What I was getting at is that the court won't garnish him for this. Sure, they can find him in contempt and all the fun that goes along with that, but not garnishing him purely for not paying the rent. It's not their debt, they're not party to the matter.
OP, out of interest, have you spoken with the landlord about this?
Yup, the court can order spousal support and get a garnishment order if he doesn't pay. What they can't do though is garnish him solely because he won't pay the rent.
Even if the court does order him to pay the rent, unless it's actually part of a support order the most they can do is hold him in contempt, fine him and all of that good stuff.
