Our HOA has implemented a "special assessment". Since they were unable to garner a quorum as per covenants and by-laws (2/3 approval by 50% of homeowners) they took a vote of the Board and implemented it (bylaws do not give them this option). I challanged them on this point (a few years ago they attempted the same thing and a judge ruled against them). Now they have place a Lien on our property. The three lawyers I have briefly spoken to tell me to pay it and avoid the grief. The HOA attorney is quoting me Florida Statute 720 et. seq.
