Hello, I am hoping to get some guidance on the proper formatting and structure to file a motion to dismiss.
I was pulled over for driving with a suspended license. At the time I was pulled over I did have my physical license with me and was unaware it had been suspended since I just moved back to Florida after living in Out of state for several months. I was issued a ticket for driving with a suspended license with knowledge. I had no knowledge.
I now have my license current and valid. A couple days ago I went to pre trial where I showed my license to the court the DA proved it was valid and offered adjudication at which time I asked the judge if I may motion to dismiss. I was told I have 10 days to file my motion.
Maybe it would have been best just to take the charge and pay the fines?
I am hoping someone will be able to direct me how to fill out my motion.
