Shoplifting, Larceny, Robbery, Theft HELP ASAP!

Does a retailer have to catch you with the item on you to charge for shoplifting? If they allegedly see you steal something but you refuse to be searched and walk out of the store, can/will they prosecute you?

That would depend on if they have evidence of the theft even without items. In most cases the answer is yes they can still charge you

Is there an average time frame in that case in which you should be notified that you are being charged?

They have until the statute of limitations runs out to file charges. That would be one to two years

Yes.

and be careful what store you try that with, stores like mine, you get brought back inside, weather you want to or not.
