Overstay, Illegal Status Hardship Application Illegal Alien

I have looked through all 17 pages on Immigration and have not found this answered. What are the chances of an illegal alien--one that crossed border w/out receiving any papers and one whose student visa exprired-- chances of getting a plr status as a spouse if they do the Hardship application also?

If the person actually entered without inspection, the only option is for that person to return home, file for the appropriate K visa along with the required waivers (usually I-212 and I-601). It's very different if the person only overstayed a visa, in that case, the alien should be allowed to adjust status in the U.S. without having to leave the country.
