I'm a student who graduated last year and now i want to apply for the H1-B and green card next year.
I'll explain my situation.
In 2008 i pleaded no contest to charges of retail theft. Under Pennsylvania law this is a crime punishable by up to 5 years, but I was enrolled in ARD program which constitutes 1 year of probation and the records were expunged after that.
This constitutes 1 CIMT offense
Now I'm working and my employer has offer sponsorship for visas and greencard.
My questions are:
Does only 1 CIMT offense that is not considered "petty" prevent one from greencard/naturalization?
Will this affect my H1-B application?
Will this affect my greencard application even if I wait 5 years?
Will this also be an issue if I apply for the greencard through marriage?
I'm very concerned about my situation and I appreciate any type of help answering my questions.
