On January 18, 2010, the USCIS posted a memo regarding Determining Employer-Employe Relationship for Adjudication of H-1B Petitions including Third-Party Placements. USCIS requires the Petioner must establish the Employer-Employee relationship exist throughout the duratio of the requeted H-1B validity period. My question is how should the benefiary establish the Right to Control over the benefiary. Should all the evidences be presented in a specific way in order for the extension to go through? Any help would be greatly appreciated.
