My friend's brother recently moved in with her and he has stayed with her 30 consecutive days. He has also received mail at her apartment and from my understanding is now a tenant that cannot be unlawfully evicted. She told me that he had grabbed her and threatened to physically harm her, so she sought and received a temporary order of protection, as well as changing the locks to her apartment to evict him.
Is this considered a lawful eviction? What would constitute a lawful eviction of a person that has resided in your home for more than 30 days in NY?
