Can a state trooper give marijuana paraphonalia back to driver and passenger(on Probation ) , then let drive .

That depends on state law and the nature of the paraphernalia. For instance, in my state possession of a marijuana pipe is no a crime. Ergo, you would probably get it back if it was initially confiscated by the police for inspection (to see if a usable amount remained int he bowl).
