I have just been denied license renewal because of an FTA/FTP on a fix-it ticket over 3 years old. The fine is ridiculous, $378.50 and I don't want to pay it. The law is is convoulted, apparently I need to have the local issuing city Police Department sign off on the correction and then notify the county. I did report to the locall Police and have the infraction signed off a week after issuance but to be honest I don't recall if I ever sent the county a copy of the signed ticket. ( I am going to look through my files for the ticket or record of postal delivery.) However, I also don't recall the City Police Department ever instructing me that I needed to inform the county of the correction. I also never recieved a courtesy notice from the county detailing what must be done to satisfy the citation as would be SOP with a moving violation. My real question is shouldn't this FTA/FTP be expunged from the record after 3 years. I am planning to take this to court and am looking for stragegies for dismissal.
Having the police dept sign off on it is just the first step. You still had a court appearance and it is not their responsibility to inform you of that fact. You already had written notification. Also a courtesy notice is just that, a courtesy. Ask for a new court appearance and hope the judge will cut you a break.
