forming an online business

I am forming an online business that will provide entertainers for bachelor parties, massages, and household chores. The business will be based out of New York. There will be a website where people can choose from a variety of girls and one of those three activites. I will also be advertising in local newspapers and various online sites such as Craigslist. I would like to know what the best structure for this business would be. I had planned on forming a sole proprietorship, solely in my name. As I read more, it seems that an LLC or INC may be safer with regards to liability. I will technically be the only person involved in the business as the girls and drivers will be indepedent contractors. Would it be safe to start out as a sole proprietorship then form an LLC in the future if the business becomes successful? Do you have any other advise for this business? Thank you.
 
I would form a business entity before starting business. And LLC is more flexible than an INC for various reasons. Your training of the girls and your SECURITY for the girls is going to be your primary problem. The fact that they are independent contractors will not shield you from liability if one of them is hurt. Further, if one of them is accused of stealing or worse you will face liability. You don't want to do this without a company entity in place.

You are going to run into a number of legal issues. You will be somewhat responsible for the girl's actions if they prostitute. You can shield yourself by having written instructions with the girls signed by both you and them. Follow them to the letter, because if they start doing things they shouldn't you will be caught up in that web.

It's a tough business. You are going to find it hard to sell your services because your competition is the illegal end of escorting and they charge the same or only a little more than you will. Good luck.

My liability concerning injuries, theft, and illegal acts was my biggest concern. My question now is if I form an LLC how much will that cost and if I give them written instructions to follow will that constitute me controlling how they do their job? I only ask because I found that in order to classify the girls as independent contractors I can not dictate how they do their job--only where they will go, the flat rate they will be paid, and the final result that I expect them achieve. Thank you for your help.
 
You need to check state laws for massage. Legit massage therapists must be licensed and conform to ethical standards. The fact that you refer to the people who will work for you as "girls" makes it sound shady and like prostitution.
 
View on your business

The online business you have chosen seems to be complicated as you are saying it is illegal. Any thing might happen and you will end up in issues. It is better to choose some other online business even though it is illegal. This business would give fatal results to girls as well as you.
