My daughter was recently diagnosed with chronic ear infections in both ears and had to have tubes put in her ears. Prior to this I had to miss many days of work due to her illness. I have since filed for FMLA and am covered for any future problems due to this. However, at this point I am already close to losing my job because of the days I missed prior to her diagnosis.

It would only make sense to me that those days would be covered as well because they were caused by this illness, however it could not have been diagnosed as such at that point, but our Disability Management Group sees it otherwise and states that since paperwork was not filed within 15days of these absences that I would not be covered.

Should I loose my job because of this, would I have the option of taking legal action, or am I simply S.O.L.?
 
The FMLA statute specifically states that FMLA coverage cannot be applied retroactively.
