Wondering if a lawyer is representing a client with 2 bench warrants against him is considered 'harboring a fugitive'?

My 3yr olds "Dad" has 2 warrants and has hired a lawyer to try to reduce his child support - which he doesn't pay. One warrant is contempt of court due to not showing up to court for a non-support hearing. The other is for not paying court fines related to assault charges. He has set up a court date (9/28) subpoenaing my daughters daycare enrollment records. I'm trying to figure out how to handle this situation (He doesn't pay child support but he can pay a private lawyer). He does not visit my daughter & we were never married. Wondering if I automatically have full custody & does he have the right to request her daycare papers?
