Fence issues

Hi, Can I just take down a fence that my neighbor put up without my agreement? He didn't get a survey, and the placement of the new fence is inside my property I believe, but I don't have a survey. He took down the old fence that was on what seemed to be the property line, (judging by other parts of the fence along the line, driveway edges, line of bushes, and so on), without my knowledge or agreement. If I take the fence down, who do the materials belong to? This is in California.

I would guess... and only guess, that before anyone tells you it's "OK" to take the fence down, they will suggest getting a survey on the properties, to determine the actual property lines.

I would think that if it came to be on your property, it's your property, but i always think so simply... hehe
