father duped into signing a will

Hello on may 12 2007 my father died from a long illness back in october of 2006 my father went into the hospital to have a kidney removed he was told from his doctor to make sure he had a will made. He had his brother as the main person in his will he revieved everything my sister was next if he died my father had a 5th grade education and told me and several family members he didnt understand the will but signed it. his brother who has been ripping him off for months in the sum of 30,000.00 after the surgery he made it and was going to change everything but was unable to as he died my father suffered from asbestoses lung cancer and diabetes he was on oxygen as well my fathers brother has stated to me he realy never liked my father but did him a favor. i was told and my sister was told my fathers doors are locked and we can not go to his house. he stripped all valuables the day he died he wasnt even in the ground yet its been 2 months now and he still hasnt got my fathers grave stone yet claims it is to expensive yet he recievied 80,000 in insurance and my fathers house is paid off. I hadnt talked with my father in 20 years but had just reunited with him again over the last few months is there a way i can go to court myself as i can not afford thousands of dollars in fees! there is so much more but will spare you the rest my father resided in the state of maine! is there any hope also my sister hasnt seen a dime from my uncle do we have any way of doing anything please!!!!!
 
You can go to the probabte court and see if the will has been filed and get a copy. You will then need to consult with an attorney. If probate has not been started, your sister may want to file to be the personal representative of the estate. Then, if there is a will, your uncle will produce it and the court will decide who is going to be the PR.
