Family Member selling art created by a disabled artist.

Hi,

I am disabled and drawing Social Security Disability Insurance. I create various forms of artwork as a hobby when I am physically able, mostly digital artwork. I only create artwork sporadically, but have quite a collection.

My wife has been using my art on products that she sells on CafePress.com. However, it hasn't turned a profit yet, and she is considering expanding into forming an LLC and then acquiring an art agent to get my artwork licensed out to manufacturers of retail goods.

At this point, I have given her the verbal copyright to use all of my work. She doesn't pay me for the artwork and she earns the income by maintaining everything on Cafepress (although I built the official site for her. I retired from Info Tech and she couldn't afford a professional).

My questions are:

Do we need legal documentation that I have given her copyrights to my work?

If she forms the LLC, will she need legal documentation to show that the LLC owns all of the copyrights to my work?

Will it affect my social security income if I occasionally volunteer to help her out?

Do I need to report anything to the SSA?
