Hello Y'all,
I need some legal help please this is kind of a custody battle too and yes I already have an attorney for the custody part. I have raised my oldest who is 12 will be 13 this week all her life and in November of 2005 her father never appeared in Court so I was granted sole and physical custody of her. I am orig from Massachusetts this is where it all started anyways he had custody taken from him knowing this all 12 years he wanted nothing to do with her has paid no child support all these years. Recently he moved down to SC in January 2015 and me being the kind hearted person that I am and having a huge heart I let him see her on the weekends. Well I had a business trip and had to be gone for 2 weeks so I left her with him because no one else could watch her while I was gone. I left March 29th and came back on April 18th my daughters father was supposed to drop her off so he did on April 19th around 2:30pm now my daughter knew I modeled but my ex brain washed her and told her I did more than modeling so that upset her. Now remember she is a minor only 12 I raised her not to swear and to be polite and well mannered, well anyways she lashed out at me calling me a whore I told her to go to her room but remember she is 12 at that age to be defiant so instead of going to her room she ran away. My daughter ran to the gas station where she apparently spent 20 min in the bathroom and then finally came out asked to use the phone and called her dad her dad showed up and lied to the cops stating that I had punched her when I never have. Remember this is the same guy before he moved down told my friends and family he was going to give the bitch what she deserves in regards to me. So he called the cops telling them that. And the cops came I was making dinner for my 2 year old and my 12 year old ask me a set of questions I answered no then walked outside to talk to the other cops came back in did not read me my Miranda rights and arrested me in front of my 2 year old who was crying saying I want mommy thank God I called my 2 year olds dad previous to pick her up. Now also keep in mind the night before I had a stroke. A few months later my case was dismissed they were trying to charge me with Neglect of a helpless child. Can I sue them for keeping my daughter from me she is still not home. And can I get her father for false accusations. And also what can I do about 1983 Police Misconduct is that irrelevant?
