My Boyfriend and I are constantly harassed by the policemen and undercover s in our town because of his past mistakes over 2 years ago. However, I was driving the other night without a license and was pulled over, when they asked my name I gave them my older sister's name.
The reason they said they pulled me over was due to a traffic violation and then when they found out who was in the car wanted to search it. Neither of us are on probation nor a fourth waiver but I allowed them to search the car anyway, so that they wouldn't give us a harder time than they were.
As we waited 3 other units arrived along with an undercover officer that knows my boyfriend from past relations. After about hour of questioning us on the curb and administering field tests on my boyfriend they placed him under arrest for being under the influence. After they detained him and stripped the car using dogs and recovering nothing from the cooperated search they were about to let me go, until 2 other agents (undercover) arrived at the scene.
The 2 agents that arrived late were ones that I had seen a few times. All the previous contacts with them resulted in nothing but frustration because they could not pin anything on my boyfriend and I. The agents took the id in the car and told me that they knew who I was and that I would be charged with a Felony for false impersonation.
I never did produce a document stating that I was my sister but I did by word of mouth state this to be the case and during that time I was not being charged with anything. Until the 2 agents arrived (1 who perticularly does not care for me) was I questioned and after not getting any answers from previous run ins, I was then arrested.
When I arrived at the station the agents gave me a chance to talk to them about the events of the night but I stated I wanted to speak to a lawyer to better understand my rights. They tricked me into stating my age but I said I don't want to say anymore and would like an attorney. I was told I would be able to have one no problem, but I wouldn't get one then I would get one sometime in jail before my hearing.
A while after not "talking" with the agents, I was then greeted by 3 other officers would said that I would be subjected to field tests. The field tests were not an issue when I was initially pulled over nor during the course of the search but only after the 2 agents came, and then knowing who I was subjected me to the tests. I'm not sure I did to well on the tests but it was late, I was running around all day.
After several tests, the officers informed that I would be giving a blood sample. I asked specifically if I could give a urine sample because I did have to go and I thought it was my right to at least provide one or the other. I was told no and pretty much forced to give my blood.
The charge was for felony false impersonation and under the influence, with a $26,000.00 bail.
What rights did I have throughout this incident? Do I still have any rights now? I can't afford an attorney will a PD be okay and what information should I provide for them to handle my case in my favor?
