Alcohol & Drugs: MIP, MIC, Intoxication fake id

I got pulled over in amherst ma and the police officer kept asking me to show him all the cards in my wallett. After some refusal I eventually showed him as he was getting pissed. I took out my brothers real NY state ID and told the cop I was holding it for him because he had left it when he visited. Inow have to go to court because he said its a fake but i had no beer or anything with me or coming from the packie. What is the penalty and do I need a lawyer?

Well I think you've got him beat on this one, for one, it is not false identification because A)it is an actual state government issued driver's license, aka not a forged document, and B) you weren't using it to purchase alcohol. The officer has no way of proving that you were intending on using it to acquire alcohol, so I'd say this is a bogus charge, but still I would at least consult a lawyer just to make sure.
