C Visa Expired C1-D Seaman's Visa

Hello, I am a Resident Alien and I want to marry my boyfriend who has an expired C1-D Seaman's Visa here in the US. I would like to know what is the best thing to do in order to petition him without having to send him back home. Thank you.

You have a difficult question to answer, especially since you are not a citizen and he has an expired visa. I am not sure there is a way to easily "cure" this condition and usually it is attempted through marriage to a US citizen. You are telling me that you are not a citizen - are you here legally? Obviously, do not post any personally identifiable information.

I am here legally since 1997 but i just have not applied my citizenship yet. I know that we would have a beter chance if I was a citizen when I petition him..so the question now is...would it be ok if I married him with just a green card status while applying for citizenship,, then wait till i get it to petition him...whats the difference?
