eviction with premature baby

i was renting a 2 bedroom i was having signs of premature labor so got permisson for my parents to move in since doctors orders were to take it easy and i also had a 2 yr old landlord said it was ok and that soon he would have a 5 bedroom available the rent was higher so we told him we'd have to rent part to my brothers he said it was fine but started threatening me with a 3 day eviction the day after we moved in few days later gave me 30 eviction for no reason the landlord told my husband he just didnt want to rent to us anymore a few days later i had my son prematurely the day the landlord found out i had him he brought over a 3 day eviction saying we broke our rental agreement by having too many people and that we owed 1400 dollars when we never even got a rental agreement set up for the new house im planning on taking him to court but im afraid since we didnt get a written rental agreement ill lose. i live in montana
