on the first of the month our landlord refused our rent payment because it was from a third party. instead he claimed we could have extra time to pay him ourselves. on the 2nd there was note on the door to pay by the 6th or they would start the eviction process. we talked to them explained we could only pay if they accepted payment from the third party. still they said no. on the 8th we recieved a notice in the mail stating we needed to vacate the property no later than 5pm on the 30th. 3 days later we were served eviction papers by the sherriff. the papers say we have a court date on the 28th. we have never been in this type of situation before and are confused on what to do. landlord wont take the payment we have. our notice says we have till the 30th but court is the 28th and of course we DO NOT want an eviction on our record. what are our legal rights in this situation? will we get evicted the 28th or do we have till the 30th? also what should we be prepared for in the court room? we are trying to find another place and plan to be out as soon as possible.

Why not have the third party give you a cashier's check made out to the landlord?
Or, just ask the third party to get a money order. The landlord doesn't need to know HOW you got the money order.
Or, ask the third party to give you cash, and you get a receipt from the landlord.

Agree, the simple thing is to get the money from the third party & then give the landlord cash, money order........
