e Bay - can seller sue non-payer?

My jurisdiction is: NewYork /erie

In the event that a buyer changes their mind within 24 hours of buying/bidding on an eBay purchase - are they obliged to make payment if they notify the seller they do not want the item ?

No monies have been paid at this point. Does the seller have the right to sue to mandate fulfillment of the purchase agreement?
 
It's a legally binding contract. You can contact the seller and see if they would sell it to the next highest bidder, but they do not have to. If you can't come to some resolution with the seller, they are within their rights to sue on the contract. (Among other options - such as eBay suspending your account.)
