Alcohol & Drugs: DUI, DWI DWI - is it a criminal violation of the law?

Recently a friend's neighbor was hit by a drunk driver and ended up in the hospital. I have heard that a DWI is not a criminal offense. I think it is a DUI because it took place in Chicago. I am not sure if there is a difference between DUI and DWI and I was hoping someone would give me some idea as I try to help my friend with information who is helping the family cope with this. They are very upset that the driver might just walk away from this pretty easily when their son could have been so easily killed. I think there should be a criminal prosecution but am not sure.

DUI and DWI are the same thing.
If a significant injury occurred it is likely a felony offense.
Your friend should be speaking with the district attorney as well as a private civil attorney.
