Ok here is the scoop buddy of mine gets a DNR permit to dig a 2 acre pond he completed that excavation a couple of years ago he had stock piled the sand in the field right next to the pond. A week ago he tells me he does not want the sand in the field that he would like to get rid of it. I tell him I can do that so I rent a screener and start in on screening it to sell to a dairy farm for cow bedding sand then the MSHA inspector shows up and tells me I am mining and do not have mining credentials tells me I have to shut down and that he is going to fine me I tell him I am not mining I did not dig the sand out of the ground it was stock piled here by the owner under DNR permitting he disagrees who is right I do not have a whole lot of money for some fines
 
Right or wrong, if I were you and didn't want to deal with "big brother" craziness, I'd do as the DNR inspector instructed you to do.

Big Brother makes the rules, and all us little sheeple must obey!

Your best bet is to do as the MSHA inspector told you to do.
