I received a speeding ticket for going 65+ in a 30 zone according to the ticket. The speed limit suggested by an engineering survey for the location of the violation was 38.8 mph. The speed limit on the opposite side of the road was 35 mph, agreeing with the engineering survey and there was no posted speed limit in my direction. Can I use the engineering survey speed limit as my defense, since from what I understand, any speed limit more than 5 mph below an engineering speed survey's suggested speed limit is not quite legal?
Besides writing down the wrong speed limit, the police officer also wrote down the wrong address/location of the violation. He also didnt use radar...the radar box was not checked off.
Do I have a case? Thank you
