State: Utah/California
I have a bit of a problem regarding a co-worker and employer.
The co-worker has an outstanding warrant for her arrest in a different state (CA) According to the legal reports it was a felony charge plead down to a misdemeanor in 2006/7.
Before serving her jail term, the person fled the state and now resides in Utah. Our current employer (in Utah) has recently been made fully aware of her legal history but continues to keep her employed and has not taken any kind of action.
I've contacted the local sheriff's office but they say all they can do is pass the information along to CA; they will not extradite for a misdemeanor. It's ironic since the charge was originally a felony that was only plead down with the promise of a jail sentence... that she skipped out on.
She claims to have gone to CA to "sort it out" but has returned within 3 days of leaving. I find it unlikely they would just let her leave the state once again once she turned herself in.
I've also contacted the HR department and they are not exactly eager to pursue a background check.
Does anyone have any advice they can offer? It seems to me that my employer is just as guilty as she is especially since they know her status but continue to keep her employed.
