Arrest, Search, Seizure, Warrant Cops destroyed vape

My friend was arrested on possession of Marijuana and had his vape on him when arrested. The police seized and destroyed the vape on the assumption that it was drug paraphernalia. They destroyed the vape before his court date and without any evidence that it was ever used for anything other than normal, legal vape juice. He is and was over 18 at the time. Is this legal for them to do? Is there any way to get him reimbursed? It was an expensive gift I bought for him that was never used for anything other than legal nicotine juices.

Make a formal complaint against the department (in writing) that demands the return of property that was seized.
He needs to do this, not you.
It may not go anywhere, but it's a start.
