Can you sue a company?

My father was layed off because his position was no longer available.

When I checked online for the company's job openings there is an opening, for the exact prosition my dad had.The position that was not available is posted. They fired him last night.

Can he sue the company for lying to him?

Well, he can, in that no law prohibits it. But unless he has a valid and supportable reason to believe that he was laid off BECAUSE OF his race, religion, national origin, or other characteristic protected by law, he won't win. Google at-will employment. Lying to an employee about the reason for their job ending is not actionable.

In at will employment you can be terminated/laid off for any reason at any time except for a reason prohibited by law (age, religion, gender.....) or unless you have a binding employment contract to the contrary.
