Hypothetically, a mother and her minor (12 years old say) go into the US on perfectly legal visiting' visas from another country.

The mother married and now has her permanent residence, but now her daughter has overstayed her visa (Now 16, but still a minor) and wants to visit her homeland, will they let her back in to the US after her stay back in her old country? Is she legal? Is she subject to deportation?

If she is no longer legal, what are the steps that can make her legal so she can come back after her stay?

The family is no drain on the country, and her daughter goes to a prestiges private school.

If the daughter does not have a green card or US immigration travel documents, then she would not be let back in here. Her mum ought to have filed for her. Talk to a lawyer to educate her on filing............I can't say morethan this without full knowledge of the whole case.......

What kind of immigration travel documents? And thanks for the quick reply!

I think it was told that the daughter's status was 'Undetermined' meaning, she wasn't illegal, but not legal either. The immigration told her mother to 'take her time' but in the same token, not take sooo long.

And something about changing her status?

(My mind is absent of law-esque knowledge. )

The mum should file for here. There are advance parole travel document she can get if she files for adjustment of status.
