Can I sue someone convicted of DUI

In Feb. 2001 I was involved in a car accident, where my car was struck my a drunk driver. His insurance company paid for the er bills and my car. The person who hit me finally pleaded guilty to the DUI charge (currently dealing with second DUI case) approximately 3 months ago. At the time of the accident I was taken to the ER but was released without any apparent injuries. Since the accident I've become a paranoid driver, afraid I'm going to be in another accident, I'm afraid to drive at night (when accident occured) and have had consistent back problems that I never had prior to the accident. I was told my an officer involved in the case that I should sue the person who hit me, I'm wondering do I actually have a case worth persuing? Any advice or information would be greatly appreciated.
 
Since you have no permanent and serious physical injuries, you are unlikely to get anything.

But talk to a personal injury lawyer to have your case evaluated.
