I was entering work through a security guards entrance. As I was about to go through the exit door when a security guard put his hands on me, leaned into me, and started pushing me backwards. I had know idea why and asked him what are you doing, he replied " i`m aloud to do this". I felt he was being to aggressive and i felt a little threatened so I put my hand on his shoulder and moved him away from me and asked him not to touch me. I asked him not to touch me 5 times. I asked him why he was being aggressive and he said he asked to look in my lunch pail and I kept walking. I told him I did not hear you. ( I have never been asked to look in my lunch bag entering work in the 19 years i`ve been there). I told my manager what happened and I started doing my work. 30 minutes later local police showed up to ask me what happened and I told them. They told me I did nothing wrong but since there was 2 security guards and one seen me put my hand on the shoulder of the other, the security guard I had a problem with issued me a citation of battery. So the police handed me a citation. The next day I returned to work I was terminated for unprovoked work violence. 2 weeks later I got my job back do to lack of evidence and the company security tape from the guard shack showed no battery. The case was thrown out of court because he did not show up. Can I sue him in small claims or civil to get 2 weeks of lost pay.
