can i move out of state with a open defacs case?

was wanting to know if i could move out of state with a open defacs case?i still have physical sole custody of my children but right now their fathers have been given temporary custody for 6 months.defacs has written up a safe care plan stating that i have to have a place to live for me and the kids for at least 6 months and i have to show that ive done counseling for at least 6 months,and pass drug test when given to me.this move will be a new start for me and my children.
 
If the children are not legally in your custody as they have been placed with their father, you may not move them out of state. Even if you had custody, the terms of your custody agreement may require agreement from the father or at least notification before moving out of state. It would also be a reason for Dad to challenge the current agreement and the children being permitted to move out of state.
