Does anyone know if in the state of Texas you can recieve deferred adjudication probation more than once? I had felony deferred ajudication in 1996 and completed it with no problem. I have not been in any trouble since. I am now facing burglary charges and my plea bargain is 6 months state jail or 5 years probation, not deferred. Thinking if I cannot get it deferred I might as well take the time.

Deferred vs probation is insignificant because the conviction isn't automatically removed. Discuss the ramifications of all outcomes thoroughly with your attorney. The prior deferred could impact any pending sentence. The TX Bar is one of several jurisdictions to which I am admitted.

Decide carefully, whatever you do. But, make sure your attorney explains the ramifications of all outcomes. You may do 6 months in state jail, but usually some form of parole follows!
