Can I buy a House while My Astranged Husband and I are still Married?

My husband and I have been separated and leaving apart for a year. Can I buy a House while we are still married without him having any rights to the property at the time of our divorce?

It depends on how your state defines marital property. If you are legally separated, then in most cases you should be okay. However, if you plan to use any marital funds to purchase the house, then your husband will probably be entitled to a share.

I wouldn't buy the house until after your divorce, or until you have consulted an attorney in your area.
